Terms of service

The rules for using Lake Pulse: accounts, subscriptions, purchases, support, content standards, and the limits of what our analysis represents.

1. Agreement

These Terms of Service govern your use of the Lake Pulse website, portal, mobile app, subscriptions, Boathouse support, and Toolbox store (collectively, the "Service"). By creating an account, placing an order, or otherwise using the Service, you agree to be bound by these terms. If you do not agree, do not use the Service.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.

If you join under a lake association or organization account, an administrator of that organization may manage your access and view data associated with the shared account.

3. Subscriptions and billing

  • Member is our free tier. Paid subscription levels add features described on the pricing page at the time of purchase.
  • Paid subscriptions renew automatically for the term selected until cancelled. You authorize us to charge your payment method each term.
  • You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
  • We may change pricing with at least 30 days' notice before the change applies to your next renewal.

4. Toolbox purchases

Products in the Lake Pulse Toolbox are sold subject to availability and the prices shown at checkout, plus applicable taxes and shipping. Shipping timelines, returns, and warranty handling are described in our Shipping & returns policy, which is incorporated into these terms.

5. Boathouse support

The Boathouse is a help desk for subscribers, not a consultancy. Included support covers questions, orientation, and referrals. Work that requires substantial staff time — such as historical data migration, custom reporting, or sampling design — is quoted separately as a flat fee and performed only after you approve it in writing.

6. Nature of the information provided

Lake Pulse provides measurements, analysis, and general guidance. A lake is a complex, spatially variable system: conditions at a boat landing can differ sharply from a remote cove on the same water body, and conditions change by season.

The Service is not a regulatory determination, a permit, an engineering design, a legal opinion, or a guarantee that any impairment will be resolved. Lake Pulse helps you build the evidence to act; decisions and their outcomes remain yours.

7. User conduct and content standards

Lake Pulse includes community features such as Field Images, Field Notes, comments, and direct communications between subscribers, Lake Admins, and Boathouse staff. You may not use these features to upload, post, or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, pornographic, invasive of privacy, or otherwise objectionable.

This includes, but is not limited to, images or language that:

  • depict or promote illegal activity;
  • are sexually explicit, gratuitously violent, or hateful;
  • evade our content filters through misspellings, code words, or other techniques;
  • falsely represent a measurement, location, date, or event; or
  • infringe the rights of any person or entity.

We reserve the right, in our sole discretion and without prior notice, to remove any content, suspend or terminate any account, and permanently ban any user who violates these standards or who communicates with Lake Pulse staff, Lake Admins, or other users in an abusive, threatening, deceptive, or inappropriate manner. Law enforcement may be notified where required or appropriate.

8. No false or disparaging claims

You may not make false, misleading, or disparaging statements about Lake Pulse, its staff, or its services in public or in communications with other users. This includes blaming Lake Pulse for your lake's impairment, claiming that Lake Pulse guaranteed a specific environmental outcome, or attributing to Lake Pulse conclusions or advice that we did not provide. If you do so, we may remove the offending content, suspend or terminate your account, and pursue available legal remedies.

9. Dispute resolution and binding arbitration

Before bringing any claim, dispute, or grievance against Lake Pulse, however big or small, you agree to first contact us in writing at info@lakepulse.co and provide us with a reasonable opportunity to resolve the matter informally. If the dispute is not resolved within sixty (60) days, you and Lake Pulse agree to resolve it through final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Sheboygan County, Wisconsin, or another location we mutually agree upon. The arbitrator's award may be entered in any court of competent jurisdiction.

You agree to bring any claim against Lake Pulse only in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or otherwise preside over any form of representative or class proceeding.

This arbitration agreement does not prevent you from filing a complaint with a government agency or from seeking injunctive relief in a court of law for intellectual property infringement or other claims where injunctive relief is essential.

10. Acceptable use

  • Do not misuse, disrupt, or attempt to gain unauthorized access to the Service.
  • Do not upload unlawful, infringing, or deliberately false data.
  • Do not scrape, resell, or redistribute the Service or its content without permission.
  • Do not misrepresent Lake Pulse analysis or attribute conclusions to us that we did not make.

11. Your content and our content

You retain ownership of the data and content you submit. You grant us a license to host, process, and display it as needed to operate the Service, and to use aggregated or de-identified data to improve our analysis.

The Lake Pulse name, logo, software, dashboards, and written materials are owned by Lake Pulse and may not be used without permission.

12. Suspension and termination

We may suspend or terminate access for violation of these terms, non- payment, or to protect the Service or other users. You may close your account at any time. Provisions that by their nature should survive — including ownership, disclaimers, and limitation of liability — survive termination.

13. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any measurement or analysis is free of inaccuracy.

14. Limitation of liability

To the maximum extent permitted by law, Lake Pulse is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

15. Governing law and disputes

These terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Disputes will be brought exclusively in the state or federal courts located in Minnesota, and you consent to their jurisdiction.

16. Changes to these terms

We may update these terms. Material changes will be posted here with a new "last updated" date and, where appropriate, communicated by email. Continued use after the effective date constitutes acceptance.
